1 Federal regulation limits third party or pre-authorized transfers (including overdraft transfers) or transfers made by telephone or personal computer to six per month, no more than three of which may be by check, draft, or check card.

2 You are eligible to contribute to an Education Savings Account if your Modified Adjusted Gross Income (MAGI) is $190,000 or less for married taxpayers or $110,000 or less for single taxpayers. Partial contributions allowed between $95,000-$110,000 if single and between $190,000-$220,000 for married filing jointly.

3 State tax treatment varies. Out-of-state 529 plans may not have the same state tax benefits as those offered to in-state residents. The tax law exempting earnings on qualified withdrawals from federal income tax expires on December 31, 2010, requiring Congress to take some further action to secure these provisions prior to this date in order for them to remain in effect following December 31, 2010. For withdrawals not used for qualified higher education expenses, earnings are subject to income taxes at the distributee's rate plus a 10% federal tax penalty. Please consult your tax advisor with any questions.
