This trust was created under the will of Charles I. Branan, who died in 1929, “and is so named in memory of my beloved mother (born 1830-died 1915), who was left a widow with seven children.”
Income of the trust is to be distributed at least annually to 501(c)(3) organizations "… for the promotion of such matters as have for their object the relief of suffering and for charitable purposes—for example, for the victims of floods, disasters, for the care of the sick, feeble, helpless and orphans. However, the manner in which these funds are to be used shall be left entirely to the discretion of the Board of Trustees and they shall not be restricted in the use of said funds to the purposes I have outlined above merely by way of illustration.”
The discretionary distribution of funds is made after the Trustee pays specific amounts for cemetery maintenance. As a result, this trust is classified as a split-interest trust, and not a private foundation.
In Mr. Branan’s will he makes no geographic restrictions on distributions. However, it has been the practice of the Trustee to make grants within the State of Georgia.
